PRIVACY POLICY

Private Fiber, Inc. ("Private Fiber," "we," "us," or "our"), a Texas C Corporation, is committed to protecting the privacy and security of your personal information. This Privacy Policy describes how we collect, use, store, share, and protect information in connection with the fiber internet services ("Services") we provide. This Privacy Policy applies to all Subscribers, users, and visitors who access our Services or website at privatefiber.com.
This Privacy Policy is incorporated by reference into the Terms of Service available at privatefiber.com/terms. By using our Services, you acknowledge that you have read, understood, and consent to the practices described herein.
1. Information We Collect
1.1 Account and Service Information
When your community is activated or when Services are provisioned to your premises, we may collect: your name, address, and unit or lot number; email address and telephone number; billing and payment information (where direct billing applies); service tier selections and equipment identifiers; HOA or community association membership information as provided by the Bulk Customer; and move-in and move-out dates as reported by the community.
1.2 Network and Usage Information
In the course of providing Services, we automatically collect certain technical and network data, including: IP addresses assigned to your connection; bandwidth usage and data consumption (aggregate volume, not content); device MAC addresses connected to our network equipment; network performance metrics such as signal strength, latency, uptime, and error rates; and CPE status, firmware versions, and diagnostic data.
1.3 Customer Proprietary Network Information (CPNI)
As a telecommunications service provider, we collect and maintain Customer Proprietary Network Information ("CPNI") as defined by the Federal Communications Commission under 47 C.F.R. §64.2001 et seq. CPNI includes information related to the type, quantity, technical configuration, destination, and amount of use of your telecommunications services, as well as billing information. CPNI does not include your name, address, or telephone number.
1.4 Website and Communications Data
When you visit privatefiber.com or contact our support team, we may collect: browser type, operating system, and device information; IP address and approximate geographic location; pages visited and interactions on our website; cookies and similar tracking technologies (see Section 7 below); and records of support requests, emails, and communications with our team.
1.5 Information You Voluntarily Provide
We collect information you voluntarily provide, such as when you complete a sign-up form, request service, sign a Customer Service Agreement via DocuSign, or communicate with our support team. This may include name, address, phone number, email, community affiliation, and plan selection.
2. How We Use Your Information
We use collected information for the following purposes: provisioning, activating, maintaining, and improving Services; billing, payment processing, and account management; network operations, capacity planning, performance monitoring, and troubleshooting; responding to support requests and resolving technical issues; communicating service updates, maintenance windows, and outage notifications; complying with legal obligations, regulatory requirements, and law enforcement requests; detecting and preventing fraud, abuse, and violations of our Terms of Service and Acceptable Use Policy; and generating aggregate, de-identified analytics to improve network design and service quality.
3. CPNI Protections
Private Fiber protects your CPNI in accordance with FCC regulations and applicable Texas law. Specifically:
3.1 Use for Service Delivery. We use CPNI as necessary to provide and bill for your Services, respond to your service inquiries, and protect against fraud and network abuse.
3.2 Marketing Restrictions. We will not use your CPNI for marketing purposes beyond the service category you currently subscribe to without your express, affirmative consent (opt-in). You may grant or revoke CPNI marketing consent at any time by contacting us in writing.
3.3 Disclosure Limitations. We will not disclose your individual CPNI to any third party, including your HOA, Bulk Customer, property manager, or developer, without your written consent or unless required by law or legal process. We may disclose aggregate, de-identified data to Bulk Customers for community-level reporting purposes, but such data will never identify individual Subscribers or their usage patterns.
3.4 Authentication. Before disclosing CPNI to any person claiming to be the account holder, we will verify identity through reasonable authentication measures as required by FCC rules.
4. Information Sharing and Disclosure
Private Fiber does not sell, rent, or lease your personal information to third parties for their marketing purposes. We may share information in the following limited circumstances:
4.1 Service Providers and Contractors. We may share information with trusted third-party service providers who assist us in operating our network, processing billing, providing eSignature services (e.g., DocuSign), or providing support, subject to contractual confidentiality obligations.
4.2 Bulk Customers (Aggregate Only). We may provide aggregate, de-identified community-level data to HOAs, developers, or property owners for the purpose of BSA reporting and service performance verification. This data will not identify individual Subscribers.
4.3 Legal Compliance. We may disclose information when required by law, regulation, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, prevent fraud, or ensure the safety of our network or users.
4.4 Business Transfers. In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of the transaction. We will notify you of any such transfer and any changes to this Privacy Policy.
5. Data Retention
We retain personal information and account data for as long as your service remains active and for a reasonable period thereafter as necessary to comply with legal obligations, resolve disputes, enforce our agreements, and support legitimate business operations. Network performance and usage data is retained in aggregate form for capacity planning and infrastructure development. When personal information is no longer needed, we securely delete or de-identify it in accordance with industry best practices.
6. Data Security
Private Fiber implements reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, or destruction. These safeguards include but are not limited to: encrypted data transmission and storage; access controls and authentication requirements for personnel; network segmentation and monitoring; and regular security assessments and updates. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security. If you become aware of a security incident involving your account, please contact us immediately.
7. Cookies and Tracking Technologies
Our website (privatefiber.com) uses cookies and similar technologies to improve functionality and user experience. These may include: essential cookies required for website operation; analytics cookies to understand visitor behavior and improve our site; and preference cookies to remember your settings and choices. You may manage cookie preferences through your browser settings. Disabling certain cookies may affect website functionality. We do not use cookies to track your internet activity outside of our website.
8. Children's Privacy
Private Fiber does not knowingly collect personal information from children under the age of thirteen (13). Our Services are provided to residential premises and are not directed at children. If we become aware that we have collected personal information from a child under 13 without parental consent, we will promptly delete that information.
9. Your Rights
Depending on applicable law, you may have certain rights regarding your personal information, including the right to: access the personal information we hold about you; request correction of inaccurate information; request deletion of your personal information, subject to legal and contractual obligations; restrict or object to certain processing of your information; opt out of CPNI marketing use at any time; and receive a copy of your information in a portable format. To exercise any of these rights, please contact us using the information in Section 13 below. We will respond to verified requests within a reasonable timeframe in accordance with applicable law.
10. Texas and Federal Compliance
This Privacy Policy is designed to comply with applicable Texas state law, including the Texas Business and Commerce Code, as well as federal regulations governing telecommunications providers, including the FCC's CPNI rules (47 C.F.R. Part 64, Subpart U). To the extent any provision of this Privacy Policy conflicts with applicable law, the applicable law shall control.
11. Third-Party Services
Our Services and website may integrate with or reference third-party services (such as DocuSign for electronic signatures, payment processors, and analytics providers). Information you provide to these third parties is governed by their respective privacy policies. We encourage you to review the privacy practices of any third-party service you use.
12. Modifications
Private Fiber may update this Privacy Policy at any time. Material changes will be posted at privatefiber.com/privacy with at least thirty (30) days' advance notice. Your continued use of Services after the effective date of any modification constitutes your acceptance of the updated Privacy Policy. We encourage you to review this Privacy Policy periodically.
